Westwater Talent terms

Tagged is open to anyone who tags @westwaterfoil.co on a foil post. There is no application. Register your handle in the Talent Rego Form to be considered for Talent and to see your posts in the Tagged hub. Tagged members do not get a personal link or earn Westwater Dollars W$.

Talent is a chosen group of 25 people or salons, selected twice a year from Tagged creators who have registered their handle with us. We choose, and these terms apply from the day we confirm your place.

Educator is by invitation from within Talent. Educators get the Talent terms plus the commission terms in section 6.

Everyone registered gets first access to new design drops, before they go on sale to everyone, while they hold a place.

A starter box of Westwater foil, sent to the address you give us.

A personal link. Every order placed through it earns you W$, our store credit (section 5).

Your tagged posts in our ads, under your handle (section 4).

Access to the Talent hub on our website.

Foil with Westwater in the content you tag us in. Only Westwater foil on camera.

Post your foil pics and tag @westwaterfoil.co in the photo at least four times a month. A post only counts when it appears in our tagged feed; captions, comments and stories do not count. On TikTok, tag @westwaterfoil.co in the caption. We count at the end of each month. #westwatertalent is recommended but never required.

Follow the disclosure rules in section 7 on every post.

Keep your Instagram or TikTok account public while you are in the program, so we can see the posts.

Get your client's okay before you film them. If your salon has a rule about filming, follow it.

A quiet month costs you that month's link W$. If a whole quarter goes by with no tagged post, we may pass your place to someone on the list.

You own every post you make. Nothing here changes that.

By joining Talent you let Westwater share any post that tags us on our own channels, with your name and handle on it, and run any of those posts as paid ads under your handle on Meta's platforms. That is a condition of the program for as long as you are in it, and it runs for 12 months after you leave.

We may trim a post to fit an ad format. We will not change what you said, add words you did not say, or remove a comment because it is critical.

You keep your moral rights. We will always credit you by the name and handle you give us.

Westwater Dollars W$ is Westwater store credit. W$1 is worth $1 AUD of store credit.

Talent earn W$ on every order placed through your personal link, and only through your link: an order placed without it earns nothing, so share it every time. The rate is 10 per cent of the order total including GST, not counting shipping, and can change with 30 days' notice.

You also earn W$ worth 5 per cent of what you spend on every order on your own Westwater account, whether or not you use your link, not counting any W$ you use to pay. It is added as soon as the order is paid.

W$ on orders through your link is added on the 1st of each month for the previous month's paid, unrefunded orders, but only if you made at least four tagged posts that month. If you didn't, that month's link W$ is lost and does not carry over. If an order is refunded, the W$ it earned is taken back off your account. It works as cash back off your next order at our checkout, on anything in the store. It has no cash value: it can never be refunded, withdrawn or paid out as cash, and cannot be transferred or sold.

To use your W$, sign in to your Westwater account at checkout (or pay with Shop Pay). Your full W$ balance is applied to the order; part balances can't be used.

W$ expires 12 months after the date it is added. Use it or lose it.

Every order placed through your link also earns the customer W$ worth 5 per cent of that order, added to their W$ Westwater Dollar credit account as soon as the order is paid, with the same 12-month expiry. If the order is refunded, that W$ is taken back.

Educators earn W$ under section 5 and, on top of that, a cash commission on every order placed through their personal link. The rate is set in your Educator agreement and can change with 30 days' notice. We do not publish it.

Commission is paid monthly for the previous month, by bank transfer, once your total owed is $75 or more. Below that it rolls over to the next month. The $75 minimum, and any amount held back for a missing ABN (section 8), applies only to Educator cash payments (cash commission and profit share), never to W$.

Educators do not need to teach for Westwater. You need to use Westwater foil in the education you run, wherever you run it.

An Educator's own print release comes with a profit share agreement, agreed with each Educator one on one and paid out in cash.

Educators earn W$ on their own orders at a percentage agreed with each Educator one on one, in place of the 5 per cent in section 5.

Educators also receive complimentary foil while they hold the level. How much, and how often, is set in your Educator agreement.

Everything you get from us, free foil, W$ or commission, is a benefit you must disclose on every post that features Westwater.

Put #ad or "Paid partnership" at the start of the caption, and use Instagram's Paid partnership label or TikTok's commercial content toggle as well. On video, say it or show it on screen.

Do not rely on #gifted, #collab, #spon, "ambassador" or a brand tag on its own. Australian advertising rules say they are not clear enough.

Do not hide the disclosure in a hashtag list, behind "more", or in your bio only.

Say what you honestly think. Do not say you bought the foil if we sent it. Do not make claims about the foil that are not on our website, and never make health, hair-loss or scalp claims.

We will never ask you to hide that you are in the program, and we will never ask you to remove a genuine negative comment. If someone from Westwater ever asks you to, email talent@westwaterfoilco.com and it will be fixed.

W$ and foil are not cash payments. The only cash we pay is Educator cash commission and profit share.

If you are an Educator, give us your ABN in the Talent hub before your first commission payment and nothing is held back.

If you do not have an ABN and a cash payment (commission or profit share) is more than $75 before GST, the law makes us hold back 47 per cent and send it to the ATO. You then claim it back in your tax return. W$ is never held back.

If you do this as a hobby and not as a business, you can sign the ATO's "Statement by a supplier" form instead and give it to us, and nothing is held back. You cannot sign it if you run a business or are entitled to an ABN.

How you treat anything you receive from us for tax is up to you. Westwater does not give tax advice.

You are an independent creator, never an employee, agent or partner of Westwater Foil Co. You choose what to post, when, and how.

Westwater is responsible for what we say. You are responsible for what you say. If you break the disclosure rules in section 7, we may pause your place until it is fixed.

A Talent place lasts 12 months from the day we confirm it. We may invite you back for another 12 months.

You can leave at any time by emailing talent@westwaterfoilco.com. We can end your place at any time with 14 days' notice, or straight away if you break section 7.

When your place ends, unspent W$ stays on your account until its own expiry date. Our right to use posts that tagged us runs to the end of its 12 months. We stop sharing new posts of yours from that day.

When your place ends, you also lose access to the Talent hub, Talent emails and first access to new design drops.

We collect the details you give us when you join to run the program and to pay you. We do not sell or share them, except with the services we use to run the store and send email. Our privacy policy applies.

We can update these terms. We will email you 30 days before a change takes effect. If you keep posting after that date, the new terms apply.
